MAGPUL INDUSTRIES ANNOUNCES LAWSUIT TO INVALIDATE COLORADO GUN CONTROL MEASURES

Denver, Colorado – May 17th, 2013 - Magpul Industries, an Erie, Colorado, based manufacturer of firearms accessories, announced today that it has joined 53 Colorado County Sheriffs and other plaintiffs in filing a lawsuit this morning to invalidate gun control measures recently passed by the Colorado legislature and enacted by Colorado Governor John Hickenlooper.

The lawsuit was filed in U.S. District Court and establishes that Colorado House Bill 1224 (magazine restrictions) and House Bill 1229 (universal background checks) violate the constitutional rights of lawful gun owners located in Colorado.

Duane Liptak, Director of Product Management and Marketing for Magpul Industries, said that these gun control laws do nothing other than restrict the ability of law abiding citizens to defend themselves and Magpul is committed to invalidating these infringements:

“Colorado’s recently passed gun control laws are a direct assault on the constitutional rights of the responsible people who live in and visit this great state. These laws will do nothing to enhance public safety and only place unreasonable limitations on the ability of law abiding citizens to defend themselves. While Magpul is currently in the process of moving its operations out of Colorado, we will not turn our back on our native state. Extreme gun control interests have forced the passage of these unconstitutional laws in Colorado, and as a company, we are resolved to restore those rights to the people.”

Magpul’s outside legal counsel, Jon Anderson, of Holland & Hart LLP, said that the Colorado gun control bills are unconstitutional and so poorly drafted that the new laws would be enforced in an inconsistent manner:

“Colorado’s gun control laws are in direct conflict with the U.S. Constitution. In addition, these bills were so poorly drafted that no one agrees on the scope of the government regulation. If teams of lawyers cannot agree on what these bills prohibit, how can we expect citizens to abide by these laws and how can we rely on law enforcement to implement these laws in a consistent manner?”

Magpul will continue to support productive efforts to FREE COLORADO from government regulations that imperil the rights of law abiding firearm owners.

“Those who do not learn from history are doomed to repeat it”

The title quote is from  George Santayana, and it remains the truth.  We are going through changes in America, changes which some people claim to be for the better.  Amongst these changes are the way our government no longer works.  We are often subjected to demagoguery, falsehoods, and even outright propaganda from our own government, not to mention the media.  Of these, the most intense and emotional debate has been over the Constitutional right to keep and bear arms under Second Amendment.

While the Second Amendment is not the highest priority problem we face, it certainly ranks near the top.  And, if nothing else, the debate raging over the Second Amendment is bringing the best and the worst in elected officials and the self-appointed elite.  Here are a few examples of the bad:
Of course there's good things happening in this debate as well.  Senator Ted Cruz was spot on during the Senate gun control hearing.  Then we had the House of Representatives dig into the corruption of "Fast & Furious", which allowed innocent Mexicans and American law enforcement agents to be murdered as a pretext for gun control.  And many gun companies are taking a moral stand against tyranny.

But we need to realize that many elected and appointed officials do not support our Constitutional rights.  Take our own state legislature as an example.  We are told that members of that elective body made a "mistake" or "did not understand" what they were agreeing to sponsor, notably HB1588 and SB5737.  These defenses have been proven wrong, and demonstrated to be disastrous for the same law abiding citizens that those elected officials claim to be protecting. 

On the high side, this is incompetence on their part.   On the low side, it's an outright attempt to deceive the voters to push agendas not of our liking.

There's no evidence that we were deliberately lied to. But hearing "Oops!" from elected officials on something this serious certainly doesn't instill a sense of confidence in voters.  "I'm too stupid to notice what I'm proposing" is disingenuous behavior.  At best. 

We need politicians who are honest about what they want.  Even if we don't like it.  Because then the dishonesty would be out in the open, and we could debate it honestly.

Which brings us to the point of this post.  If the sponsors of HB1588 and SB5737 actually want to impose draconian gun control laws on us, there are plenty of historical precedents on the matter.  Below the fold is a classic example of gun control, one that many people seem to have forgotten....and the results of that gun control effort.

The Washington State Legislature website

The Washington State legislature has an excellent web site, well organized, and plenty of search features.  Bookmarking this page for your use is strongly recommended.  Here are some useful functions on the main page that you might use (they are tabs across the top):
  • Committee meetings:  Schedules and agendas of the various committees in the Legislature, selectable by date.
  • Legislator Information: Rosters, e-mail services, legislator home pages, and caucus home pages.
  • Find Your District: A quick reference to find your Legislative District by street address.
  • Bill Search: Find bill information by bill number (a 4 digit number).
  • Find Laws & Rules: A means to research the Revised Code of Washington (RCW), Washington Administrative Code (WAC), and Register.
There are other features as well.  For example, each bill has sponsors, and must pass through committees.  The web site allows you to find out how to identify the sponsors, the membership of the assigned committee, and even to see which bills each member of the State legislature are sponsoring.

Below the fold are two examples for the 16th Legislative District, using two bills recently introduced to the 2013 legislature.

New Gun Control Legislation Introduced on Capital Hill

The following new bills have been introduced in the House and Senate, in addition to those introduced last week:
  • HR 449: To provide an amnesty period during which veterans and their family members can register certain firearms in the National Firearms Registration and Transfer Record.
  • S 179: The Gun Trafficking Prevention Act: A bill to prevent gun trafficking.
  • S 174: The Ammunition Background Check Act: A bill to appropriately restrict sales of ammunition.
  • HR 431: To restore certain authorities of the Bureau of Alcohol, Tobacco, Firearms, and Explosives to administer the firearms laws.
  • HR 427: The Trafficking Reduction and Criminal Enforcement (TRACE) Act: To prevent the illegal sale of firearms.

Second Amendment Legislation Roll Up

There are many problems facing our nation, and not just infringements or violations of the Constitution.  But this is an excellent example of just how Congress works, and and a possible method to help to focus your attention on a specific topic, while discussing (yet another) direct assault on the Constitution.

This listing was extracted from the POPVOX blog, and is a summary of legislation related to the Second Amendment, as of January 25th, 2013. There are 30 bills in this list; 25 are sponsored by Democrats, and 5 by Republicans.  Some Democrats have sponsored more than 1 bill; for example, Senator Lautenberg (D-NJ) has sponsored 4: S. 22, 33, 34, and 35 (Perhaps coincidentally, Senator Lautenberg has at least one Democrat seriously challenging him for the 2014 primary election). All of them further impinge upon the Second Amendment to some degree; a few are deceptive in how they do so.

In an example of both, Congressman James Moran (D, VA-8) is sponsoring HR 21, The NRA Members' Gun Safety Act: To provide for greater safety in the use of firearms.  But, according to the Firearms Policy Coalition:
H.R. 21 would extend the Brady Law background check procedures to all sales and transfers of firearms. The bill would also require the reporting of thefts within 48 hours; require that all states that allow residents to carry concealed firearms institute a permitting process requiring that the applicant demonstrate good cause for requesting a LTC and that the applicant is “worthy of the public trust” to carry a concealed firearm in public; and allow the Attorney General to deny the transfer of a firearm or deny a firearm (or explosives) permit to persons known or suspected of terrorist acts.
The text of the bill is consistent with the Coalition's statement, and with Congressman Moran's past legislative activities.  The bill is anything but Second Amendment friendly.  So it's worth noting that you need to read the bill before it's passed in order to know what's in it.

While the Republicans have fewer bills in the pipeline, those are consistent in supporting the Second Amendment to some degree:

  • House Resolution 40, House Resolution expressing that active duty military personnel who are stationed or residing in the District of Columbia should be permitted to exercise fully their rights under the Second Amendment to the Constitution of the United States.
  • HR 410, The Restore the Constitution Act: To provide that any executive action infringing on the Second Amendment has no force or effect, and to prohibit the use of funds for certain purposes.
  • HR 35, Eliminating ‘gun free zones’ in schools. To restore safety to America's schools. 
  • HR 133, The Citizens Protection Act: To repeal the Gun-Free School Zones Act of 1990 and amendments to that Act. 
  • S 82, The Separation of Powers Restoration and Second Amendment Protection Act: A bill to provide that any executive action infringing on the Second Amendment has no force or effect, and to prohibit the use of funds for certain purposes.

Note that many bills never make it out of committee, so this is simply an indication of the general direction of each party thus far.  Finally, this list has not been checked against Thomas.gov:
